1. Who you're dealing with
KC Mobility Scooter Rentals LLC ("we," "us," "the Company") is a Kansas limited liability company operated by Jeffrey Guzman, with a physical shop at 703 Pennsylvania Ave, Leavenworth, KS 66048. Phone: 913-775-1098. Email: jeff@kcmobilityscooterrentals.com.
We are a hospitality rental business. We are not a medical provider, durable medical equipment supplier, prescriber, or HIPAA-covered entity. We do not bill insurance, accept Medicare/Medicaid, or provide clinical assessments. The equipment we rent and resell is for personal mobility use, not medical treatment.
2. Rentals
Booking
- Rentals are reserved through our website or by phone/text/email.
- A reservation is confirmed when you receive an email or text confirmation from us — not at the moment of submission.
- We may decline any reservation at our discretion (e.g., equipment unavailable, delivery outside service area, policy concerns).
Payment
- Rental, delivery, and any applicable taxes are charged at booking unless otherwise agreed in writing.
- Payment is processed by Stripe. Card details never reach our servers.
- If a deposit hold is required for the rental, it's authorized at handoff against the saved card and released or captured after return.
Use
- Equipment must be used for ordinary personal mobility — no commercial use, no resale, no modification.
- You are responsible for the equipment from delivery/pickup until return. Treat it as you would your own.
- Do not exceed the equipment's posted weight capacity.
- Do not operate while impaired.
- Outdoor and indoor use are both permitted within manufacturer guidelines. We will tell you of any specific limitations on the model you rent.
Returns
- Return the equipment at the agreed time and condition.
- Late returns beyond a 30-minute grace window incur an additional rental day at the prevailing daily rate.
- Damage: ordinary wear is included in the rental. Damage beyond ordinary wear (cracked frames, broken controllers, water damage, missing parts) is charged at our cost to repair or replace, up to the deposit amount.
- Loss or theft: if equipment is lost, stolen, or unreturned, you are liable up to the manufacturer's replacement cost.
Cancellation and refunds
- Cancellation 24+ hours before rental start: full refund.
- Cancellation under 24 hours: 50% refund.
- No-show or cancellation after rental start: no refund.
- If we cancel for our reasons (equipment failure, scheduling, weather), you receive a full refund or a rebooking at no extra charge — your choice.
- Refunds process to the original payment method within 5–10 business days.
3. Selling equipment to us (cash purchase of Pride mobility scooters)
- We buy used Pride Mobility scooters specifically: Victory 10/10S, Go-Go Sport, Go-Go Traveller, and LX with CTS Suspension. We do not buy other brands or other categories.
- Cash offers are based on photos sent before the visit. We reserve the right to adjust the offer at the visit if the equipment differs materially from the photos (undisclosed damage, dead battery not visible in photos, etc.). We will tell you the new offer and you may decline.
- Sale is final at pickup. Cash is paid on the spot. No warranty transfers.
- We do not buy stolen equipment. By selling to us, you represent that you own the equipment outright and have the right to sell it.
4. Free haul-away service
- We offer free pickup of mobility scooters (any brand), wheelchairs, hospital beds, hoyer/patient lifts, sit-to-stand machines, ramps, stair lifts, walkers, rollators, and mobility batteries within our service area, subject to photos and our acceptance.
- Free haul-away is not tax-deductible. We are a for-profit business, not a registered charity.
- Once we have removed the equipment from your premises, ownership transfers to us. We dispose, refurbish, recycle, or resell at our discretion.
- We do not pick up oxygen concentrators, IV poles, programmable medication carts, or anything regulated as Class II/III durable medical equipment. Those need a compliant DME-recycler route.
- We pick up only what was disclosed in the inquiry. We do not haul additional household items not arranged in advance.
5. Kiosk and event services
- At in-person events where we operate a self-service kiosk, walking up and using the tablet constitutes acceptance of these terms and the rental agreement displayed at the kiosk.
- Pre-registration via /book-event is non-binding until you complete the rental at the booth.
- Claim codes from /book-event are valid only for the active event and expire when the event ends.
- We may require ID at handoff. Where camera-based ID capture is enabled, the photo is stored and handled per our Privacy Policy.
6. Use of the website
- You may use the site for ordinary purposes — browsing, booking, contact, customer-account access.
- Do not scrape, mass-download, or attempt to access systems you're not authorized to access.
- Do not impersonate another person or submit knowingly false information.
- The site and its content are owned by us or our licensors. You may share links to public pages freely.
7. Pricing, taxes, and fees
- Prices on the site are in U.S. dollars and may change without notice. The price displayed at the moment you confirm a booking is the price that applies to that booking.
- Sales tax is calculated based on the delivery address (or pickup location) using Stripe Tax. Tax-exempt customers must provide a valid resale or exemption certificate prior to booking.
- Delivery fees are zone-based on driving distance from our Leavenworth shop. The exact fee is shown at booking before you confirm.
8. Liability and assumption of risk
Mobility scooters, wheelchairs, and similar equipment have inherent operating risks. By renting from us, you acknowledge:
- You are operating the equipment yourself or directing its operation.
- You assume the risk of ordinary use including tipping, falls, collisions, and battery failure.
- We are not liable for indirect or consequential damages (missed events, hotel-rate differences, lost vacation time) arising from equipment issues.
- Our maximum liability for any rental is limited to the total amount you paid for that rental.
- Some states do not allow limitations on incidental or consequential damages, so portions of this section may not apply to you. You retain any statutory rights you have under Kansas law.
The signed rental agreement you complete at booking includes the full waiver and assumption-of-risk language and controls in case of conflict.
9. Indemnification
You agree to indemnify and hold harmless KC Mobility Scooter Rentals LLC, its members, employees, and contractors from claims, damages, and reasonable attorney's fees arising from your misuse of the equipment, your breach of these terms, or your violation of law in connection with using our service. This does not apply to claims arising from our gross negligence or willful misconduct.
10. Privacy
How we handle your information is described in our Privacy Policy. By using our service you acknowledge those practices.
11. Disputes and governing law
- These terms are governed by Kansas law.
- Disputes will be resolved in the state or federal courts of Leavenworth County, Kansas. You and we both waive any objection to that venue.
- Before filing a lawsuit, please email jeff@kcmobilityscooterrentals.com to attempt informal resolution. Most disputes are resolved with a phone call.
- If any provision of these terms is held unenforceable, the remaining provisions remain in effect.
12. Changes to these terms
We may update these terms. The "last updated" date at the top reflects the most recent revision. Material changes (cancellation policy, fees, liability scope) get an email notification to active customers. Continued use of the site or our services after a change means you accept the updated terms for new bookings.
